At McShan Law, we encourage all potential clients to meet with attorneys and find someone who understands their position and with whom they feel comfortable. If the client and attorney are not in sync as to how the case should be handled or how the relationship should work, then it is not a fit. This does not mean either the client or attorney is good or bad; it is a process to see if the relationship will work.
We handle all different types of family law cases and take the approach of (when applicable and in the client’s best interest) encouraging amicable solutions so that you can move forward to your next chapter more quickly and with less stress and cost. This does not work in all situations, and we are always ready to switch gears and go to court. We advise our clients as to the pros and cons of each decision and help guide clients through the process.
We offer a wide range of services including Adoption, Divorce, Business Divorce (for business owners), Child Custody and Visitation, Collaborative Law, Paternity Determination, Premarital Agreements, Court Order Modifications, Property Settlements, and Child Support. We also specialize in same-sex cases related to the above services.
Additionally, we handle estate planning and probate.
Most of our clients prefer to meet via Zoom, but we are happy to meet in person at the office as well. We are happy to accommodate client wishes when it comes to how we conduct meetings.
Our office is open Monday through Friday, 8:00a.m. – 5:00 p.m. However, we are often working outside those hours as well.
Yes, we do charge for consultations. In your consultation we discuss your case, the underlying law, and various strategies you will want to consider when moving forward with your case. This planning meeting/consultation offers insight into your case as well as providing strategy and information about the family codes. Additionally, after we consult with you, we are conflicted out of the case and cannot represent another party.
This is always a hard question, and you get the “lawyer answer” of it depends. We have handled cases that have been resolved for under $2,500.00 and those that have cost more than $100,000.00. It depends on what all is involved in the case, how often you are going to court, and how it is ultimately resolved (agreements, jury trial, etc.). Throughout the process, we highlight cost-saving options for our clients and outline upcoming costs. It is up to our clients how they want to proceed, and these choices impact the cost of the case overall.
As attorneys, you are paying for our time and expertise. We bill by the hour, but in 0.1 hour increments. We help you understand the basics of the law, and we apply the law to your facts, advising you accordingly. As we go through the process, there are filings, discovery, correspondence with both clients and opposing counsel, correspondence with the court, court appearances, mediation, and trial – just to name a few.
